Terms of Service

1. Acceptance of Terms
By accessing or using Encore ("the Platform"), operated by Matt Senjem Music LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.
2. Description of Service
Encore is a live music request and tipping platform that connects performing artists with their audience in real time. Fans can scan a QR code at a live performance to browse a musician's setlist, request songs, and send voluntary tips. Musicians use a dashboard to manage requests, sessions, and payments.
3. User Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the payment features of the Platform. Users under 18 may browse public pages but may not submit tips or create accounts without parental consent.
4. Accounts
Fan accounts are optional. You can submit requests and tips as a guest without creating an account. Creating a fan account enables additional features such as following artists, receiving notifications, and viewing request history.
Musician accounts require registration via email and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5. Tips and Payments
Tips are voluntary payments from fans to musicians. By submitting a tip, you acknowledge that it is a gratuity and not a payment for goods or services.
All payment processing is handled by Stripe. By making a payment, you also agree to Stripe's Terms of Service. Encore does not store credit card numbers or sensitive payment information.
Tips are generally non-refundable. See our Refund Policy for exceptions.
The Platform may charge a service fee on each transaction. Musicians who connect their own Stripe account receive tips directly, minus the platform fee and Stripe processing fees.
6. Prohibited Conduct
- Submitting fraudulent payments or chargebacks
- Harassing, abusing, or threatening musicians or other users
- Submitting offensive, obscene, or hateful content in song requests or dedications
- Attempting to exploit, hack, or disrupt the Platform
- Impersonating another person or entity
- Using the Platform for any illegal purpose
7. Intellectual Property
Song titles, artist names, and related metadata displayed on the Platform are for reference purposes only. Encore does not claim ownership of any musical works. Musicians are responsible for ensuring they have the right to perform requested songs at their events.
8. Limitation of Liability
The Platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Matt Senjem Music LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of revenue, data, or profits.
9. Termination
We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, musicians, or the Platform.
10. Changes to Terms
We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will indicate the date of the most recent update at the top of this page.
11. Governing Law
These Terms are governed by the laws of the State of Minnesota, United States, without regard to conflict of law provisions.
